Buying property in Spain

The Spanish purchase process moves fast once a reservation is signed, and most of the buyer's leverage exists before that point. This is what the process looks like when it is run properly.

Who this is for

  • Foreign buyers
  • Non-resident purchasers
  • Buyers with financing

Before the reservation

Property checks, budget of total acquisition costs, NIE and power of attorney if needed.

The deposit contract

The arras contract determines the penalties on both sides. Its drafting decides your position if anything fails.

Mortgage timing

Financing conditions must be reflected in the contract, otherwise a refused loan can cost you the deposit.

Completion

Notary signature, payment mechanics, keys, registration and the transfer of supplies and community.

Frequently asked questions

What are the total costs beyond the price?
Transfer or VAT, notary, registry and professional fees. We give a written budget of total acquisition cost before you commit.
Can I lose my deposit?
Yes, under a standard arras contract. Which is exactly why the contract, and the conditions in it, need negotiating.
Do I need to be resident to buy?
No. Non-residents can buy freely; they need a NIE and are subject to specific ongoing tax obligations.
